Assumption of Risk
I acknowledge that this activity involves known and unanticipated risks, including but not limited to drowning, hypothermia, collisions with watercraft or submerged objects, changing weather and water conditions, and physical exertion. I understand that such risks cannot be eliminated without jeopardizing the essential qualities of the activity, and I expressly agree and promise to accept and assume all of the risks existing in this activity. My participation is purely voluntary, and I elect to participate in spite of the risks.
Equipment and Safety Gear
I agree to wear a U.S. Coast Guard approved personal flotation device at all times while on the water, and to inspect rental equipment before use. I accept full responsibility for loss of or damage to rented equipment beyond normal wear.
Swimming Ability
I certify that I am able to swim and that I am not under the influence of alcohol, drugs, or any medication that impairs my judgment or physical ability.
Release and Waiver of Liability
In consideration of being permitted to participate in water sports activities and/or the rental of watercraft and related equipment, I, for myself and on behalf of my heirs, assigns, personal representatives and next of kin, hereby release, indemnify, and hold harmless the business, its officers, employees, and agents (the "Released Parties") from any and all claims, demands, losses, and liability arising out of or related to any injury, disability, death, or loss or damage to person or property, whether arising from the negligence of the Released Parties or otherwise, to the fullest extent permitted by law.
Medical Authorization
I certify that I am physically fit and have no medical condition that would prevent my safe participation. I authorize the business to secure emergency medical treatment on my behalf if needed, and I agree to be financially responsible for any such treatment.
Severability and Governing Law
I agree that this agreement is intended to be as broad and inclusive as permitted by the laws of the state in which the activity takes place, and that if any portion is held invalid, the remainder shall continue in full legal force and effect.
